What Is the H1B Visa?
A non-immigrant US work visa for speciality occupations, covering almost all software engineering roles. Employer-sponsored. You cannot apply independently.
- Annual cap: 85,000 (65,000 general + 20,000 for US master's holders)
- 2026 registrations: ~470,000
- Selection odds: 14–18%
- Duration: 3 years, renewable once
- Green card path: Yes via EB-2/EB-3, but Indian national backlogs exceed 50 years
Full Timeline 2026–2027
- January–February: Employer registers you, pays $10 fee
- March 1–18: Registration window opens
- Late March: USCIS runs lottery, notifies selections
- April 1 – June 30: Employer files full petition if selected
- August–September: USCIS adjudicates (premium processing = 15 business days)
- October 1: Employment begins
What If You Are Not Selected?
Four realistic alternatives:
- L-1 Intracompany Transfer: Work abroad at a multinational for 1 year, transfer to US office. No cap, no lottery. Cleanest path for engineers at large companies.
- O-1A Extraordinary Ability: Open source contributions, patents, conference talks. No cap, no lottery. High documentation bar.
- Canada PR then TN Visa: Express Entry PR in 6–12 months, then TN visa to work in the US as a Canadian resident. Increasingly common.
- Re-register next year: Many employers keep engineers on remote contracts between lottery cycles.
Premium Processing
$2,805 in 2026. Guarantees USCIS action within 15 business days. Does not improve approval odds; it only speeds the decision. Most large tech employers cover this cost.
